Consensual divorce: how the process works

Consensual divorce requires that both spouses agree to end the marriage. If there are minor children, a further written agreement on custody, contact, and maintenance is required — this agreement is a precondition for the process to proceed.

There are two main routes: the notarial route, where the agreement to end the marriage is drawn up before a notary with lawyers assisting, and the fully digital process via gov.gr, available to couples without minor children and without outstanding property matters that need resolving.

In both cases, each spouse needs their own lawyer, even when the agreement is complete — the lawyer's role here is to make sure the agreement correctly reflects the client's wishes and is legally complete.

If at some point there is no agreement — for example on custody or property — the matter cannot proceed as consensual and the court route is considered instead. How realistic it is to reach full agreement depends on each couple's specific situation and is discussed at the initial meeting.
